Terms of Use

These terms are an agreement between you and Setout Labs LLC ("we", "us") covering your use of the Stayline mobile app and this website (together, the "Service"). By downloading or using the Service you agree to them. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old and able to enter into a binding agreement with us. If you use the Service on behalf of an organization, you confirm you are authorized to accept these terms for it.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own non-commercial use. Your trip data is yours; we claim no rights in it and, because it never leaves your device, we never hold it.

3. Acceptable use

Do not use the Service unlawfully, attempt to gain unauthorised access to it, introduce malicious code, or interfere with its operation. Do not reverse engineer, decompile, resell, sublicense or redistribute the app except where that restriction is prohibited by law.

4. Intellectual property

The Service, including its software, design, text and marks, is owned by Setout Labs LLC and protected by intellectual property law. These terms grant you no rights in it beyond the licence in section 2.

5. Day counts are planning information, not advice

Stayline is an independent planning tool. It is not affiliated with, endorsed by, or connected to any government or immigration authority, and nothing in the app is immigration, legal or tax advice. Always confirm your status with the relevant authorities before traveling.

The app counts the dates you enter. It cannot verify them, and it does not model every rule that may apply to you, including EU-spouse rights under Directive 2004/38, long-stay D-visa exemptions, national long-stay rules, residence permits, or a border officer's discretion. You are responsible for the accuracy of the dates you enter and for your own compliance.

6. Stayline Pro and purchases

The day counter is free. The trip simulator is part of Stayline Pro, which starts with a 14-day free trial that asks for no payment method and no account. After the trial, Stayline Pro is available as a monthly or an annual auto-renewing subscription, or as a one-time Lifetime purchase. The current price of each is shown in the app before you buy.

A subscription renews automatically at the same price and period unless it is cancelled at least 24 hours before the current period ends. Manage or cancel it in your App Store account settings; cancelling stops the next renewal and leaves the period you have already paid for running to its end. Payment, prices, taxes, receipts and refunds are handled by the app store you downloaded Stayline from, under that store's terms, not by us.

7. Third-party services

The app stores, and your device platform, are operated by third parties under their own terms and policies. We are not responsible for those services.

8. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any count it produces will match a determination made by any authority.

9. Limitation of liability

To the maximum extent permitted by law, Setout Labs LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, denied entry, missed travel, fines or penalties, arising out of or related to your use of the Service. Our total liability for all claims is limited to the greater of the amount you paid us in the twelve months before the claim or fifty U.S. dollars (USD $50). Some jurisdictions do not allow these limits, in which case they apply to the fullest extent permitted.

10. Indemnification

You agree to indemnify and hold Setout Labs LLC harmless from claims, damages and expenses arising from your use of the Service or your breach of these terms.

11. Termination

You may stop using the Service at any time by deleting the app. We may suspend or terminate your licence if you breach these terms. Sections 4, 5 and 8 through 13 survive termination.

12. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Disputes will be brought in the state or federal courts located in Delaware, unless the mandatory law of your country of residence requires otherwise.

13. Changes

We may update these terms. The effective date above will change, and continued use of the Service after that date means you accept the current terms.
